Terms of Service

This document is a public offer by Jamakase Technologies LLC setting out the terms on which the AgentArea service is provided. By registering, or by topping up your balance, you accept these Terms in full.
1. Definitions
Company — Jamakase Technologies LLC, Tax ID (ИНН) 9728013548, Registration no. (ОГРН) 1207700353101, Butlerova str. 17, floor 3, room 95, office 182, Moscow 117342, Russia.
Service — the AgentArea cloud platform for running and managing software agents.
Balance — the prepaid amount held in your account, in Russian roubles, from which the cost of services rendered is deducted.
Rates — the prices published on the Pricing page.
2. Subject of the agreement
2.1. The Company provides access to the Service and supplies computing resources and language-model calls; you pay for them as set out in section 4.
2.2. Services are delivered remotely over the internet. No copy of any software is transferred to you.
3. Registration and your account
3.1. Using the Service requires registration. You agree to provide accurate details and are responsible for keeping your credentials safe and for everything done under your account.
3.2. By registering you accept these Terms and our Privacy Policy.
4. Payment
4.1. The Service is prepaid. You top up your Balance and the cost of the services you actually consume is deducted from it as they are rendered. The minimum top-up is 100 ₽.
4.2. You are billed for what you consume — tokens processed by language models. Rates are quoted in roubles per 1,000,000 tokens, separately for input and output, and differ per model. There is no subscription fee for access to the Service.
4.3. The rate that applies is the one published on the Pricing page at the time of the model call. The Company may change the Rates by publishing a new version on that page; changes do not apply to services already rendered.
4.4. A service is rendered when the model call completes. Services rendered and amounts deducted are itemised in your account and evidence the volume supplied.
4.5. If your Balance is insufficient, the Service is suspended until you top up. Paying after the fact (postpaid) is available only under a separate written agreement.
4.6. Payments are made in Russian roubles through the payment provider ЮKassa. The Company neither receives nor stores card details. A fiscal receipt is issued for every top-up as required by Russian Federal Law No. 54-FZ and sent to the email address given at checkout. Not subject to VAT (simplified tax regime).
5. Refunds
5.1. You may stop using the Service at any time and ask for the unspent part of your Balance back.
5.2. Services already rendered are not refundable.
5.3. Refunds are made within 10 working days of receiving your request, by the same method you paid with. How to ask is described on the Payment and refunds page.
6. Intellectual property
6.1. The AgentArea name, logos, design and site content belong to the Company.
6.2. The open-source part of the platform is distributed under the Apache 2.0 licence and is available in the public repository. These Terms do not restrict any right granted by that licence; they govern the cloud Service only.
6.3. Data you upload and the output of your agents remain yours. The Company acquires no rights in them and uses them solely to provide the Service.
7. Acceptable use
7.1. Do not use the Service for unlawful activity, to infringe the rights of others, or for anything that places undue load on the Company's infrastructure.
7.2. Do not use the Service to send unsolicited bulk messages.
7.3. You are responsible for the content you place in the Service. The Company does not pre-screen it, but may suspend an account where that content breaks the law.
8. Support
8.1. Support is included at no extra charge, at info@agentarea.ai.
8.2. We answer on working days, usually within one.
8.3. We may ask for account details and a description of the problem in order to help.
9. Warranty and liability
9.1. The Service is provided “as is”. The Company does not warrant that it will meet your expectations or suit any particular purpose.
9.2. The Company is not liable for indirect losses, lost profit or lost data, to the extent permitted by applicable law.
9.3. The Company's total liability under these Terms is in any event limited to the amount you paid for the Service over the preceding three months.
9.4. If a service was not delivered or was defective through our fault, the corresponding charges are either credited back to your Balance or refunded, whichever you prefer.
9.5. The Company is not a telecommunications operator and does not provide you with internet access.
10. Term, changes and termination
10.1. These Terms take effect when you accept them and continue until either party terminates.
10.2. The Company may change these Terms by publishing a new version at agentarea.ru/legal/terms. Changes take effect on publication and do not apply retroactively to services already rendered.
10.3. The Company may terminate for breach of section 7. Any unspent Balance is returned under section 5.
10.4. You may terminate at any time by ceasing to use the Service and requesting your remaining Balance.
11. General
11.1. Matters not covered by these Terms are governed by the law of the Russian Federation.
11.2. Disputes are to be settled by negotiation first, with a written claim answered within 30 calendar days. Failing that, they are heard by the court at the Company's registered address, unless consumer protection law provides otherwise.
11.3. If any provision is held invalid, the remainder stays in force.
